Our firm has now filed what is the first Stryker lawsuit against Howmedica Osteonics and Stryker Orthopaedics, claiming damages caused by the company’s defective Rejuvenate and ADM hip implant systems. In this case, our complaint sets forth that Stryker failed to use reasonable and due care for the safety and well-being of patients in the development, testing, marketing, packaging, and selling of the defective product.
Stryker undertook a national recall of Rejuvenate and ADM hip implant systems on July 4, 2012 after numerous reports of failure and patient problems with the products. Searcy Denney partner Cal Warriner has said the recall is tantamount to an unequivocal admission by Stryker as to the dangers and defects in the Rejuvenate and ADM hip products.
Currently there are more than 60 adverse event reports filed with the FDA’s MAUDE incident reporting system and the Rejuvenate device has been on the market since 2009 and the number of incidents has been climbing exponentially since the beginning of 2012.
These hip implant systems are marketed to last 15 or 20 years before failure. With the Rejuvenate and ADM hip implants, we are seeing failures occurring in two years and patients are looking at removal and replacement. Stryker must now face the patients and the damages that these defective systems have caused.
